Abstract

The article presents a detailed and comprehensive analysis of the relationship between the secular State, religious freedom, and the presence of religious symbols and monuments in public spaces. It highlights the importance of understanding the principle of secularism of the State in the Brazilian context, considering the protection of fundamental rights, including freedom of belief, the free exercise of worship, and the preservation of religious diversity in society. The interpretation of the Federal Constitution about religious manifestations reveals that religion is recognized and protected as a constitutional good worthy of protection and promotion by Public Authorities. The constitutionality of works and monuments with religious content in public spaces is examined with respect for religious freedom, the appreciation of local culture and history, and the recognition of the importance of religious identity for Brazilian society. The debate surrounding the presence of religious symbols in public spaces involves considering the limits between state neutrality and respect for religious diversity. Recognition and respect for existing religions in Brazil's historical and cultural processes are highlighted as fundamental elements to promote peaceful and plural coexistence. Freedom of religious expression, the protection of cultural assets, and the promotion of religious diversity are highlighted as responsibilities of the Brazilian State. The text emphasizes the importance of not banning or destroying existing monuments or religious symbols, which could be interpreted as insulting the community's freedom and right to religious expression. When addressing judicial decisions and authorities' positions in the presence of religious symbols in public institutions, the text reflects on the need to respect and guarantee religious freedom, promoting tolerance and inter-religious understanding in Brazilian society. In short, the discussion presented highlights the importance of reconciling the principle of secularism of the State with the protection of religious freedom and respect for cultural and religious diversity in Brazilian society, recognizing the relevance of faith and religious expression as integral elements of the identity of the Brazilian people.
