The “chokehold” case: dolus eventualis or gross negligence?

This essay is structured as follows: first, it succinctly presents a concrete case adjudicated by the Military Court of Justice of Minas Gerais (TJMMG), concerning the commission of negligent homicide due to lack of skill in applying a chokehold technique on a person who physically resisted during a police approach. Next, it discusses the subjective element of the conduct (eventual intent or gross negligence) based on different dogmatic conceptions of the topic. Finally, it questions the soundness of the court’s decision according to the criteria of contextual interpretation within the framework of the meaningful theory of crime.
