Simplification of legal language in the academic field

Abstract

This article addresses discussions on the simplification of legal language in the academic field. The search for keywords in a virtual environment of academic texts yielded scientific production containing scientific articles and papers over the last ten years, which illustrates the concern with including the topic in the training of future legal professionals. The unanimity of the selected authors regarding the reasons for the simplification of legal language shows an evolution in the Brazilian legal field, which has begun to observe it as a means of access to justice, in accordance with the Federal Constitution of 1988. In addition, it aligns discussions in the national legal field with international jurisdictions and academic debates. The simplification of legal language points to several paths to be followed, gradually indicating the initial procedures that should be used to simplify legal language. The counterpoint present in the article, based on classical Rhetoric, refers us to a tradition that is little practiced and proposes reflection on the paths to simplification. The collection of ideas presented here shows unanimity regarding suggestions for simplification and therefore contributes to the establishment of a movement in line with the highest law of the Brazilian State.
